Accident Admin Fee

In the event of damage on the vehicle, we do not charge an Accident administration fee.

Overdue Rental Fee

In the event that you keep the vehicle longer than intended or indicated to Wise Wheels Car Rental, we will continue to charge at the rate that was agreed on a daily basis.  We may need to increase our authorization depending on how long you still require the vehicle.

Additional Driver charge

We have a policy that we allow one additional driver will be added to the contract at no charge.  We do require the license of any person that will be driving the vehicle.

Age of driver

Unless otherwise stated, the driver of the vehicle must be at least 23 years old and have had his / her license for 2 years or longer.

International Visitors

There is no difference in the terms and conditions for SA drivers and international drivers.  Please adhere to all local laws.

Cross Border requests

Our vehicles are not allowed to cross the border.  For any requests of this, we will direct you to a company that we think would be suitable.

Currency Information and Restrictions

Our local currency is Rands, indicated by ZAR or simply “R”

Delivery and collection fees

If and when delivery or collection fees are charged, we will make the renter aware of this before the rental.

Driver’s Licence

Renters and additional drivers must be in possession of a valid unendorsed driver’s licence of country of residence

E-Toll Charges and Traffic Admin fee

In the event that there are additional charges such as e-tolls or traffic fines, we will charge this to the credit card when we recieve the notice.  A traffic admin fee for speeding fines and traffic violations will be stipulated in the signed contract.

Method of Payment

We require a credit card for authorization when the renter is given the vehicle.  This can be Visa, Mastercard or American Express (Amex).  We take authorization at the beginning of the rental, and take payment against the authorization once the rental is complete.  The bank will release the balance of the authorization that we hold.  There are some banks that take longer than others.

We are able to use some debit cards, but would need to check before you book the vehicle.

One Way fee

As we operate in the Western Cape only, we do not have need for a one way fee.  If we need to recover the vehicle from an area outside our normal operation, the cost of that recovery will be for the clients account.

Fuel / Petrol

Unless otherwise stated, all our vehicles use unleaded (95 octane) fuel in Cape Town.

Rates

Our rates do changed according to specific criteria.  You will be made aware of the amount in the quote if one is recieved, as well as the contract that is signed.

Standard Rental Contract Fee

We have a contract fee for all our rentals, this will be indicated in the quote and on the contract

Tax / VAT

The country tax / vat amount is 14%

Waivers / Insurance

With all rentals, the renter is subject to an excess amount.  The amount will be indicated in the quote and on the contract.  If there is an option to reduce the excess amount, this must be signed for in the provided space.

THE RENTAL CONTACT

​The contract that will be signed when the rental vehicle is handed over to the renter will be the contract that is binding by law in the Republic of South Africa.

​At the place on the date specified overleaf (or at such other place or on such other date as agreed to by the parties in writing) the Renter shall return the vehicle together with all its accessories undamaged and in the same condition as when received, fair wear and tear accepted.  Ownership of the vehicle shall always remain vested in Wise Wheels Car Rental.

The renter acknowledges receipt of the vehicle in good order and condition and acknowledges that the fuel tank, oil reservoir and radiator are at the time of receipt of the vehicle by him filled to capacity.  The renter shall be liable for the cost of all fuel consumed by him during the currency of the agreement or until such time as the vehicle is returned to Wise Wheels Car Rental (whichever period shall be the longest)

The vehicle shall not be used or driven:
a)  for the conveyance of any person or property for consideration expressed or implied
b)  in contravention of the law
c)  by any person who has given Wise Wheels Car Rental any false information
d)  in any race, speed or other motor sports event
e)  to tow or propel any other vehicle or trailer unless by prior arrangement
f)  by any person under the influence of alcohol or drugs
g)  by any person under the age of 23 years
h)  by anyone other than a licensed driver authorized by Wise Wheels Car Rental by the insertion of such person name on the rental contract, but not withstanding the afore going the Renter at all times be personally liable for the actions of the driver and the fulfillment of the terms and conditions hereof.
i)  the vehicle shall not be removed from the Republic of South Africa without the written consent of Wise Wheels Car Rental

The Renter shall pay to Wise Wheels Car Rental on demand all charges as they become due in terms of this agreement, in the absence of a predetermined agreed tariff such payments shall be made in accordance with the applicable tariff as set out in Wise Wheels Car Rental current tariff brochure.

The Renter shall be liable to pay:
a)  a charge calculated at the rate specified or otherwise applicable for the distance covered from Wise Wheels Car Rental depot where the renter received the vehicle and back to such depot.  The renter confirms the correctness of the odometer readings.  Where such odometer ceases to function through mechanical failure, the kilometerage covered shall be assessed by Wise Wheels Car Rental in its discretion and such assessment shall be binding upon the renter.  In the event of the odometer ceasing to function for any other reason, Wise Wheels Car Rental may at its option either assess the kilometerage covered or, where the seals have been broken or tampered with, charge the Renter a rental of not less that R4.00 per hour for the duration of this agreement or until the vehicle is returned (whichever period is the longest) and/or 400 kms per day
b)  Time charges, vehicle insurance, personal accident insurance premium and any other charges specified on the face thereof
c)  in the event of the vehicle not being returned to a depot or agreed place of return, a collection charge calculated at the rate specified for the kilometers covered by Wise Wheels Car Rental from Wise Wheels Car Rental depot, where the Renter received the vehicle and back to such a depot, in order to collect the vehicle, plus a charge for all petrol consumed during such collection.  Such charges also apply for special services; other than the client collecting the vehicle from one of our depots.
d)  All fines, penalties and court costs imposed for parking or traffic offenses whilst the vehicle is held or used pursuant to this agreement
e)  Wise Wheels Car Rental legal costs on attorney and client scale, incurred in collecting payments

Under no circumstances shall either the Renter or the authorized driver be or be deemed to be to the agent, servant or employee of Wise Wheels Car Rental

Wise Wheels Car Rental shall not be liable for the loss of or damage to any property left or transported in or upon the vehicle

The vehicle is insured in the terms of the provision of the Motor Vehicle Accidents Act and under an Insurance policy as hereinafter in respect of the said insurances and as a condition of this agreement the Renter warrants that:
a)  Neither he/she nor any person who to his knowledge will drive a vehicle with defective hearing; ever had a fit; has any physical infirmity; been convicted of any offence connected with the driving of any motor vehicle; had any motor license endorsed or cancelled.
b)  No insurer or Underwriter in respect of any motor insurance has ever declined his application, cancelled his policy; refused to renew his policy; required and increased premium or imposed special conditions on him or the driver

The vehicle described on the front of the Agreement is covered under an Insurance policy issued by a registered insurer against:
a)  Loss of and or damage to the vehicle, subject to excess as stated on Page 1
b)  damage to the property of Third Parties other than where such damage is caused through the fault of the Renter or driver of Wise Wheels Car Rental vehicle.  Excluded from the benefits of the insurance concerned are contents of the vehicle hereby subject to compliance with the warranties set out in Paragraph 7 above, and subject to the provisions of Paragraph 3 above, and provided that the Renter shall have initiated the box under the heading Liability on the front of the agreement, the renter shall be entitled to the benefits of such insurance, provided further that the Renter or driver of the vehicle :
a)  Has not breached any provisions of this agreement
b)  Shall immediately report to Wise Wheels Car Rental any damage, accident, breakdown or theft involving the vehicle or its accessories
c)   Immediately delivers to Wise Wheels Car Rental every demand, notification, summons, or process received relating to any claim, action or prosecution in connection with any collision or occurrence involving the vehicle
d)  Refrains from admitting liability for any claim or assisting any claimant in regards thereto
e)  Co-operates with Wise Wheels Car Rental or its insurer in the investigation and defense of any prosecution, claim or action
f)  Shall only be responsible for the compulsory excess referred to in Wise Wheels Car Rental Brochure

Should the renter decline, fail or neglect to initial the box under the heading “Liability” on the front of the agreement, he shall be fully liable for the total amount of damages sustained by the vehicle irrespective of whether the vehicle is driven by the Renter or anyone else.  The insurance policy herein before referred to obtained by Wise Wheels Car Rental, does not apply to or cover:
a)  any damages which Wise Wheels Car Rental may suffer as the results of loss of use of the vehicle owing to its destruction to damage thereto, for which damage the Renter shall be liable
b)  claims arising from injuries received by passengers of the vehicle; and
c)  damage or destruction of property owned by, rented to, in charge of or transported by the Renter or driver
d)  Loss of and damage to wheels and tyre
e)  Any accessories supplied with the vehicle
f)  Any towing/salvage fees which the damaged vehicle may incur

Wise Wheels Car Rental accepts no responsibility for delays in consequence of breakdown or other circumstances

The Renter undertakes to return the vehicle to Wise Wheels Car Rental for service and lubrication after every 5000km traveled or alternatively to satisfy Wise Wheels Car Rental that he had effected at his own cost the service and lubrication required in accordance with the manufacturers specifications.  Failing the Renter compliance with this clause he shall be liable for any damages which Wise Wheels Car Rental may suffer in consequence of such failure

​In the event of it being necessary for repairs to the vehicle or any part thereof, or parts to be replaced, the Renter shall be entitled to have such repairs affected or such parts replaced provided that the cost thereof does not exceed the sum of R100.00.  In the event of any repairs being affected or parts being replaced in excess of the amount of R100.00, shall be borne by the Renter, unless prior written consent of Wise Wheels Car Rental has first been had and obtained.

​The Renter shall not in any manner alienate or transfer his rights of obligations arising out of this contract

In the event of a breach of the terms and conditions of this agreement in the opinion of Wise Wheels Car Rental the vehicle is being driven or used in a manner which is likely to be prejudicial to Wise Wheels Car Rental or any person, it shall be entitled to forthwith terminate this agreement and to take immediate repossession of the vehicle without prejudice to any other claims of any nature whatsoever that it may have against the Renter

Notwithstanding anything to the contrary herein contained, the Renter shall be cooperative against Wise Wheels Car Rental unless contained in writing and signed by Wise Wheels Car Rental

​No variations or waiver or any of the conditions hereof shall be operative against Wise Wheels Car Rental unless contained in writing and signed by Wise Wheels Car Rental

​The parties hereto agree that in any legal proceedings arising out of or in connection with the agreement, the Magistrates Court having jurisdiction over the person of the Defendant, in terms of Section 28 of the Magistrates court Act, shall have jurisdiction in respect of such legal proceedings notwithstanding that the amount claimed, in such proceedings; shall exceed the normal jurisdiction of the Magistrate court.  For the purpose of such proceedings the Renter hereby chooses as domicillium citandi et executandi the address 9 Zastron Road, Milnerton, 7441, Cape Town, South Africa
